Покупка тура - тот случай, когда есть смысл заплатить за известное имя. Имидж в турбизнесе - почти все. На срок поездки турист фактически вверяет агентству свою судьбу, поэтому первое, о чем стоит задуматься: с кем заключать договор. По статистике, чаще всего жертвами обмана становятся клиенты мелких турагентств с причудливыми названиями. Не проходит и сезона, чтобы в новостях не засветилась очередная афера. Схема фирм-аферистов проста: предлагаются самые низкие цены, особенно в пик сезона. Пословица «Дешево хорошо
не бывает» тут верна, как никогда. Исчезают такие деятели так же мгновенно, как и появляются, порой люди даже не успевают вернуться из поездки. Уже позже выясняется, что и договор составлен неграмотно, да и лицензии-то у отправителя не было. А лицензия - это второе, на что надо смотреть, учитывая, что на продажу заграничных туров требуется специальная лицензия на международный туризм. У нелегальной фирмы отсудить при необходимости ничего не удастся.
То же самое с авиабилетами и страховкой: летать и страховаться надо с известными, проверенными компаниями. У этих участников туристического рынка свои договоренности с клиентом. В первом случае официальный документ - это билет, во втором - страховой полис. Об этих бумагах не забывают, но читают их совсем невнимательно, что неправильно, ведь турфирма за срыв обязательств партнеров прямой ответственности отнюдь не несет.
Есть, правда, «вариант отступления». Согласно статье 28 закона «О защите прав потребителей», турист вправе расторгнуть договор и вообще отказаться от поездки, скажем, при серьезной за-держке авиарейса. В договор вносят отдельный пункт, устанавливающий порядок расчетов на этот случай. Но это уже совершенно другая история.
Прописные истины
Договор между туристом и турфирмой считается заключенным, если между сторонами достигнуто соглашение по всем существенным условиям. Существенные условия - это и есть те самые прописные истины, которые необходимо зафиксировать. Подробно они расшифровываются в статье 10 закона «Об основах туристической деятельности в РФ». Особое внимание надо обратить на следующие моменты.
* Наличие в договоре информации о туре, которая должна быть не только
ВЫ ПРАВИЛЬНО ВЫБРАЛИ ФИРМУ, ГРАМОТНО ОФОРМИЛИ ДОГОВОР. ОТПУСК УДАСТСЯ НА ВСЕ СТО? НЕ ВСЕГДА
ФОРС-МАЖОР: Проведение тура стало невозможным по причине повреждения отеля, в котором предполагалось размещение ту-ристов или введения чрезвычайного положения в регионе. Подобные обстоятельства классифицируются как обстоятельства непреодолимой силы (форс- мажор). В соответствии с п. 3 ст. 401 ГК РФ в этом случае стороны полностью освобождаются от ответственности за неисполнение или ненадлежащее исполнение своих обязательств. Следовательно, если осуществить тур в регион, в котором введено ЧП, невозможно, то турфирма, по общему правилу, не будет нести ответственность за неисполнение или ненадлежащее исполнение своих обязательств по договору (ст. 10 ФЗ «Об основах туристской деятельности в РФ»)

В первую очередь обратиться в страховую компанию, так как возмещение ущерба, причиненного несчастным случаем, входит в компетенцию страховщика.
Вы вправе предъявить претензии и непосредственно виновнику ДТП, например, перевозчику.
Если в суде будет установлено, что поездка организовывалась турфирмой и входила в тур, то возможно взыскание компенсации с турфирмы
достоверной, но и максимально подробной. Турист, к примеру, вправе попросить турфирму уточнить такие понятия, как «недалеко от моря» или «оборудованная детская площадка». Есть смысл конкретизировать и оснащение номера в отеле. Неважно, что в договоре указана звездность гостиницы - в разных странах одинаковое число звезд может подразумевать различный уровень сервиса.
* В договоре должен быть обозначен порядок организации трансфера, услуги гида и возможные форс-мажоры. Кстати, именно в последний пункт находчивые агентства вворачивают коварную фразу о возможной замене отеля. Турист имеет полное право на-стоять на ее исключении, равно как
и на добавлении любых принципиально важных для него позиций. Розничная цена туристического продукта и условия его оплаты, как правило, прописываются в путевке, которая является неотъемлемой частью договора. Турфирма обязана выписать эту путевку, и в ней должны быть проставлены реальные даты и суммы.
* В договоре должны быть расписаны права и обязанности сторон и условия урегулирования возможных споров.
Ну и, само собой, должны быть обозначены сроки поездки, личные сведения о туристах и реквизиты турфирмы. Только под таким юридически грамотным договором можно подписываться. Приличная турфирма постарается такой договор не нарушать. И последняя деталь: все претензии к фирме-отправителю должны быть предъявлены не позднее чем через 20 дней с момента окончания действия договора. Сразу после этого, как в старой доброй сказке, «карета превратится в тыкву», и доказывать что-то будет уже совершенно бесполезно.
